Welcome to Sidekick, an experimental conversational platform powered by Decart.ai that allows users to engage in real-time interactions with AI-generated characters (the "Platform"). These Terms of Use ("Terms") govern your access to and use of the Platform, including its features, content, services, and underlying technologies, accessible via sidekick.decart.ai or through the Sidekick app.

By accessing or using Sidekick, you confirm that you understand and agree to be bound by these Terms and our Privacy Policy. If you do not agree to the Terms, please do not use Sidekick.

1. Overview

Sidekick enables users to initiate text and/or video-based conversations with AI characters. You can submit prompts, personal preferences, media, or dialogue ("Input") and receive responses ("Output") generated through our AI models. Together, Input and Output constitute "Content."

2. Eligibility

You must be at least 18 years old to use Sidekick. By using the Platform, you confirm that you meet this requirement, or that you are over 13 and have parental permission.

3. Account

To interact with Sidekick characters, you may need to create an account. You are responsible for safeguarding your login information and all activity under your account. Please inform us immediately of any unauthorized use.

4. Use of the Platform

Subject to these Terms, Decart.ai grants you a personal, limited, non-transferable license to access and use Sidekick for personal, non-commercial purposes. You may not use the Platform to:

• Violate laws or third-party rights.
• Submit harmful, illegal, or deceptive content.
• Attempt to reverse-engineer the system.
• Impersonate others or misrepresent your identity.

5. Content Ownership & Use

• You own your Input.
• Decart.ai assigns to you all rights in your Output, subject to these Terms.
• We may use Content to improve the platform, train models, and for research, security, or promotional purposes.

Note: Due to the nature of generative AI, similar Output may be generated for different users. Content generated by others is not considered your property.

6. Accuracy & Limitations

Sidekick characters are fictional entities powered by machine learning. They may provide inaccurate, incomplete, biased, or inappropriate responses. You agree to use Sidekick for entertainment, educational, or creative purposes only—not as a source of professional or factual advice.

7. Payments

Access to Sidekick is currently free, but some features may require payment in the future. You will always be notified before incurring any charges.

8. Third-Party Content

Sidekick may include links to or interactions with third-party platforms. We are not responsible for their content, services, or privacy practices.

9. Intellectual Property

All branding, platform elements, and Sidekick character IP are owned by Decart.ai or its licensors. You may not use, reproduce, or repurpose these without permission.

10. Feedback

We welcome feedback and ideas. By submitting suggestions, you grant us the right to use them without obligation or compensation.

11. Termination

We reserve the right to suspend or terminate your access to Sidekick at any time for any reason, including violation of these Terms.

12. Disclaimers

Sidekick is provided "as is." We do not guarantee the accuracy, reliability, or appropriateness of any character interactions. Decart.ai disclaims all warranties to the maximum extent permitted by law.

13. Limitation of Liability

To the fullest extent permitted by law, Decart.ai is not liable for any damages resulting from your use of the Platform, including lost data, revenue, or emotional impact from character interactions.

14. Arbitration & Dispute Resolution

Disputes will be resolved through binding arbitration in New York, NY, unless you opt-out within 30 days of accepting these Terms. Class actions and jury trials are waived.

16. Updates

We may update these Terms periodically. Continued use of Sidekick after such updates constitutes acceptance.
